Revision of regulations on management and use of fees in the field of plant protection

The Ministry of Finance is drafting a Circular amending and supplementing the Circular No. 231/2016/TT-BTC stipulating the collection rates, regimes on collection, remittance, management and use of fees in the field of plant protection; Circular No. 285/2016/TT-BTC stipulating the collection rates, regimes on collection, remittance, management and use of fees in veterinary work; Circular No. 286/2016/TT-BTC stipulating the collection rates, regimes on collection, remittance, management and use of fees for food safety and quality control in agriculture.

Accordingly, the draft Circular amends and supplements to Circular No. 231/2016/TT-BTC the on management and use of fees in the field of plant protection. Specifically, according to Circular No. 231/2016/TT-BTC, the management and use of fees is as follows: Organizations in charge of fee collection, including the Plant Protection Department and National Agro-Forestry-Fisheries Quality Assurance Departments (for cases which adopt mechanism of autonomy and self-responsibility in the use of payroll and administrative management expenses), shall be allowed to subtract 75% of the fee collected to cover expenditures for the spending contents as stipulated in Article 5 of Decree No. 120/2016/ND-CP. 25% of the collected fee shall be transferred into the state budget.

The draft Circular proposes amendments and supplements to current regulations on management and use of fees are as follows: Organizations in charge of fee collection, including the Plant Protection Department and National Agro-Forestry-Fisheries Quality Assurance Departments (for cases which adopt mechanism of autonomy and self-responsibility in the use of payroll and administrative management expenses):

  1. a) The National Agro-Forestry-Fisheries Quality Assurance Department Branch I shall be entitled to subtract 40% of the collected fee to cover expenditures for the spending contents as stipulated in Article 5 of Decree No. 120/2016/ND-CP. 60% of the collected fee shall be transferred into the state budget.
  2. b) The National Agro-Forestry-Fisheries Quality Assurance Departments Branch II shall be entitled to subtract 20% of the collected fee to cover expenditures for the spending contents as stipulated in Article 5 of Decree No. 120/2016/ND-CP. 80% of the collected fee shall be transferred into the state budget.
  3. c) The National Agro-Forestry-Fisheries Quality Assurance Departments Branches VI and VII shall be entitled to subtract 65% of the collected fee to cover expenditures for the spending contents as stipulated in Article 5 of Decree No. 120/2016/ND-CP. 35% of the collected fee shall be transferred into the state budget
  4. d) The National Agro-Forestry-Fisheries Quality Assurance Departments Branches III, IV, V, IX and the Plant Protection Department shall be entitled to subtract 95% of the collected fee to cover expenditures for the spending contents as stipulated in Article 5 of Decree No. 120/2016/ND-CP. 5% of the collected fee shall be transferred into the state budget
  5. dd) The National Agro-Forestry-Fisheries Quality Assurance Departments Branch VIII shall be entitled to subtract 85% of the collected fee to cover expenditures for the spending contents as stipulated in Article 5 of Decree No. 120/2016/ND-CP. 15% of the collected fee shall be transferred into the state budget.

In addition, the draft also proposes amendments and supplements to regulations on management and use of fees in Circulars 285/2016/TT-BTC and 286/2016/TT-BTC of the Ministry of Finance.
